1. The Experience
Top End Untold (“we”, “us”) provides self-guided GPS walking experiences delivered via a Progressive Web App at app.topenduntold.com.au. Experiences are accessed using a unique access code purchased through our website.
2. Purchase and Access Codes
Each purchase generates a unique access code delivered to the email address provided at checkout. Access codes are single-use and are tied to one device session at a time. Codes do not expire. We are not responsible for codes shared with or forwarded to unintended recipients.
3. Refund Policy
Access codes are non-refundable once delivered, as they provide immediate access to digital content. If a genuine technical fault prevents you from completing an experience, contact us at hello@topenduntold.com.au within 14 days of purchase and we will provide a replacement code or full refund at our discretion.
4. Safety and Personal Responsibility
Top End Untold experiences take place in public outdoor spaces. You are responsible for your own safety at all times. Stay aware of your surroundings, follow all posted signage and exercise caution near roads, water and wildlife. Do not use the experience while driving or cycling. Parents and guardians are responsible for supervising children at all times.
We recommend wearing appropriate footwear, bringing water and sunscreen and using one earbud rather than two so you remain aware of traffic and other hazards.
Top End Untold does not control or maintain the public spaces in which experiences take place. We are not liable for injury, loss or damage arising from participation in any experience, to the extent permitted by Australian Consumer Law.
5. Content Accuracy
We make every effort to ensure historical and factual accuracy in our experiences. Content is researched from primary sources and reviewed regularly. If you believe any content is inaccurate, please contact us at hello@topenduntold.com.au.
6. Privacy and Data
What we collect: Your email address (at purchase, for access code delivery), anonymous gameplay progress (stop completion, puzzle attempts, feedback responses), and basic device information (browser type, screen size) for troubleshooting.
What we don't collect: We do not collect your name, physical address, phone number or payment card details. All payment processing is handled securely by Stripe — we never see or store your card information. GPS location data is processed locally on your device to trigger experience stops and is not stored on or transmitted to our servers.
What we use it for: Delivering your access code, enabling resume functionality if you pause an experience, improving our experiences based on anonymous usage patterns, and responding to feedback or support requests. Third parties: We do not sell, rent or share your personal data with any third party. Our payment processor (Stripe) has its own privacy policy at stripe.com/au/privacy.
Data deletion: To request deletion of any data associated with your email address, contact us at hello@topenduntold.com.au and we will action your request within 14 days.
Updates: We may update this policy from time to time. The current version will always be available on this page.
7. Intellectual Property
All audio narration, artwork, puzzle design, and experience content is the intellectual property of Top End Untold (ABN 75 100 685 375). Reproduction, redistribution or commercial use of any content is prohibited without written consent.
8. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies rights and remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Our services come with guarantees that cannot be excluded under Australian Consumer Law.
